      Article 1 For the purpose of strengthening customs supervision and control over transit goods,Safeguard China's sovereignty, security and interests,Promote trade facilitation,In accordance with the Customs Law of the People's Republic of China, the Biosafety Law of the People's Republic of China, the Import and Export Animal and Plant Quarantine Law of the People's Republic of China and its implementing regulations, the Frontier Health and Quarantine Law of the People's Republic of China and its implementing rules, and the relevant provisions of relevant laws and regulations,Formulate these measures。

      Article 2 The term "transit goods" as mentioned in these Measures refers to the goods that are shipped out of China and continue to be shipped out of China by land。

      Transit goods from countries or regions with which China has concluded or jointly participated in international treaties and agreements containing provisions on the transit of goods shall be permitted to transit in accordance with the provisions of the relevant treaties and agreements。Other transit goods shall be approved by the competent department of commerce and transportation of the State and submitted to the customs of the place of entry for the record before being allowed to transit。Where laws and regulations provide otherwise, such provisions shall prevail。

      Article 3 The transit of the following goods is prohibited:

      (1) Goods from or destined for our country from countries or regions where trade is suspended or prohibited;

      (2) arms, ammunition, explosives and munitions, except those transported by military means;

      (3) potent poisons, narcotic drugs, opium, morphine, heroin, cocaine and other drugs;

      (4) Hazardous waste and radioactive waste;

      (5) Special articles such as microorganisms, human tissues, biological products, blood and its products;

      (6) alien invasive species;

      (7) Ivory and other endangered animals and plants and their products, except as otherwise provided by law;

      (8) Items prohibited from entering the country as stipulated in the Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine, except as otherwise provided by law;

      (9) causing harm to China's politics, economy, culture or morality;

      (10) Other goods whose transit is prohibited by State regulations。

      Article 4 Transit goods shall be subject to customs control from the time of entry to the time of exit。

      Without Customs approval, no unit or individual may open, pick up, deliver, dispatch, exchange, modify, mortgage, pledge, retain, transfer, change marks, divert for other purposes or make other disposal of transit goods。Animals and plants, their products and other quarantine objects shall not be discharged from the means of transport during transit without customs approval。

      Article 5 The person in charge of the means of transport responsible for the transport of transit goods within the territory (hereinafter referred to as the "person in charge of the means of transport") shall be approved by the relevant department of the State to carry out transit goods transport business and shall be recorded at the Customs in accordance with relevant provisions。

      Article 6 Transit goods shall be transported from the point of entry to the point of exit along the routes prescribed by the competent department of transport. In the absence of such provisions, such provisions shall be made by the Customs。

      Animals transported through the territory shall be transported along the routes specified by the Customs。

      Article 7 Transit animals and other transit goods assessed as high biological safety risks shall enter the country through designated ports。

      Article 8 The person in charge of a means of transport shall submit a declaration form for the transport of goods in transit and make a truthful declaration to the customs at the place of entry。

      The goods in transit are animals or plants, their products or other quarantine objects,The quarantine certificate issued by the animal and plant quarantine organ of the government of the exporting country or region shall be submitted;Where the goods in transit are animals,An animal transit permit issued by the Customs shall also be submitted at the same time;The transit goods are dual-use items and other goods restricted by the State,The relevant license shall be submitted。

      Article 9 Transit goods may not be transported in transit until they have been examined and approved by the customs at the place of entry。If quarantine inspection is required according to law, transit transport shall be carried out after passing the quarantine inspection。The carcasses, excrements, bedding materials and other wastes of transit animals must be disposed of according to law and shall not be abandoned without authorization。

      Transit goods may not be transported out of the country until they have been written off by the customs at the place of exit。

      Article 10 Transit goods shall not be transported with other inbound and outbound goods and articles by mixed van or container。

      Article 11 The Customs may place seals on domestic means of transport or containers carrying transit goods, and no one may open or damage them without authorization。

      Article 12 Where transit goods need to be replaced by means of transport or containers after they have been removed from the place of entry and before they arrive at the place of exit, the person in charge of the means of transport shall apply to the customs of the place of change for transshipment transport。

      Transit goods shall be reloaded in warehouses or places designated or approved by the Customs, and hazardous chemicals and dangerous goods shall be reloaded in places with safe operation conditions approved by relevant departments。

      Article 13 If transit goods with a full waybill need to be replaced by means of transport or containers during domestic transport, the person in charge of the means of transport may apply to the customs of the place of entry and the customs of the place of change for transit transport and change of loading in one go。

      Article 14 The Customs may, as required by its work, assign officers to escort transit goods, and the person in charge of the means of transport shall provide convenience。

      Article 15 The Customs may inspect transit goods when it deems it necessary, and the person in charge of the means of transport shall be present to cooperate。

      Article 16 In case of loss or shortage of transit goods within the territory, except for force majeure reasons, the person in charge of the means of transport shall complete the relevant customs formalities with the customs at the place of entry。

      Article 17 Transit goods that have not been declared to the Customs for more than three months from the date of entry of the means of transport shall be regarded as imported goods and shall be dealt with in accordance with the relevant provisions of the Customs Law of the People's Republic of China and other laws and regulations。

      Article 18 Transit goods shall be transported out of the territory within six months from the date of declaration of entry by the means of transport.Under special circumstances, an extension may be granted with the approval of the customs at the place of entry, but the extension period shall not exceed three months。

      If the transit goods are not transported out of the country within three months of the time limit specified in the preceding paragraph, they shall be extracted and sold off by the Customs according to law。Where laws and regulations provide otherwise, such provisions shall prevail。

      Article 19 Goods in transit shall not be included in the statistics of trade in import and export goods, and the customs shall conduct individual statistics。

      Article 20 Where the goods in transit are not declared or the declaration is untrue, the Customs may give a warning or impose a fine of not more than 30,000 yuan。

      Any other violation of these measures shall be punished by the Customs in accordance with relevant laws and regulations;If the case constitutes a crime, criminal responsibility shall be investigated according to law。

      Article 21 The General Administration of Customs shall be responsible for the interpretation of these measures。

      Article 22 These Measures shall come into force on November 1, 2022。The Measures of the Customs of the People's Republic of China on the Control of Transit Goods promulgated by the General Administration of Customs No. 38 on September 1, 1992 and amended in accordance with the General Administration of Customs No. 198 on November 26, 2010 and No. 240 on May 29, 2018 shall be repealed simultaneously。
